LIVING THE UPSIDE COMPETITION

Competition Terms & Conditions (“T’s & C’s”)

These T’s & C’s (as may be amended from time to time) explain your rights and obligations in relation to the Competition. By entering or accepting a prize, you agree to be bound by these T’s & C’s. Please read them carefully and pay particular attention to all terms in bold.

1. Competition Name

Living the Upside Competition (“Competition”).

2. Promoter’s Details

This Competition is conducted by Kwena Square Mall (“Mall”), owned by Redefine Properties Limited (Registration Number: 1999/018591/06) (“Landlord”).

For purposes of these T’s & C’s:

  • The promoters are referred to as “the Landlord”.
  • Entrants are referred to as “Participants” or “you.”

3. Eligibility: Who May Enter

To participate, you must:

  • Be 18 years or older, with a valid South African ID or passport (foreign nationals included).
  • If under 18, have parent/guardian consent.
  • If under 15, entries must be submitted via a parent/guardian’s Facebook account.
  • Have access to Facebook and/or the internet.

Standard data and cellular rates apply.

4. Who May NOT Enter

The following persons may not participate:

  • Directors, members, partners, employees, agents, or consultants of the Landlord or the Mall.
  • Marketing service providers.

  • Any individual directly or indirectly controlling, or controlled by, the above.

  • Immediate family members, spouses, or life/business partners of such persons.

5. Competition Period

The Competition will run from 1 September 2025 to 30 September 2025 (“Competition Period”). Entries received outside this period will not be considered.

6. How to Enter

During the Competition Period, Participants (or their parents/guardians for children’s entries) must:

  1. Visit the Mall’s official social media pages (“Social Pages”):

Facebook: Kwena Square
Instagram: @kwenasquare

  1. Find the pinned competition post (“Post”).
  2. Comment on the Post, answering:
    “What does Living the Upside mean to your kids?”

  3. Include the hashtag #LivingTheUpside in your comment.
  4. Submit the entry (“Entry”).

Once steps 1–5 are completed, the entry will be deemed valid.

No additional fees apply; however, standard data costs are for the Participant’s own account.

  1. Limitation on Entries

Each Participant may enter only once during the Competition Period.

8. Winner Selection

The Winner will be chosen by the Landlord through a random electronic selection process.

9. Winner Announcement

The Winner will be announced by 7 October 2025, or at a later date as determined by the Landlord.

  1. Prizes
  • The Winner will receive vouchers valued at R2,500.00 (Two Thousand Five Hundred Rand).
  • ⚠️ Prizes are non-transferable, non-exchangeable, and not redeemable for cash.

  • Vouchers are valid only for the period stated on the voucher.
  • Prizes are provided courtesy of the Landlord and subject to additional terms imposed by the Landlord.

  1. Winner Notification
  • Winners will be contacted by the Landlord via direct Facebook message and telephone.
  • If the Winner cannot be reached within 14 days, their entry will be disqualified, and a new Winner will be selected electronically.
  • The replacement Winner will also be notified via tagging on Facebook/Instagram and contacted directly.

  1. Prize Collection
  • Winners must arrange collection with Centre Management.
  • Prizes can be collected at Centre Management offices during:

    1. Monday, Wednesday, Friday – 08h00 to 14h30.

  • The Winner must:
    1. Collect the prize in person.
    2. Present a valid ID or passport.

    3. Complete and sign a waiver form before the prize is handed over.

The Landlord may withhold the prize until the waiver is completed.

  1. Deadline for Claiming Prizes

Prizes not collected within 14 days of notification will be forfeited, and another Winner will be selected.

14. Data Usage & Privacy Policy

By entering, Participants acknowledge that the Landlord may collect and use personal information, which may include:

  • Full name
  • Address

  • Email address

  • Mobile number

  • Images/photographs

This data may be used for future marketing activities, unless the Participant opts out. Personal information will be kept confidential and disclosed only if required by law.

These T’s & C’s are available at no cost on the Mall’s:

  • Official website
  • Facebook page

  • Instagram page

  1. General Terms

16.1 The Landlord may terminate the Competition at any time before its end date, without liability. 16.2 The Landlord is not responsible for lost, delayed, or misdirected entries due to technical failures.
16.3 By entering, Participants automatically accept these T’s & C’s. 16.4 A Participant may not win more than one prize in a 30-day period. 16.5 Winners may be photographed for Mall promotional purposes (social media, website, industry publications). Winners may decline publication.
16.6 The Landlord does not guarantee that participation will result in winning or that prizes will meet expectations.
16.7 To the extent permitted by law, the Landlord is not liable for any loss, injury, harm, or damages arising from participation, except in cases of fraud or gross negligence.
16.8 Participants must comply with all applicable laws, including intellectual property rights.
16.9 These T’s & C’s are governed by South African law. 16.10 The Landlord’s decision is final and binding, and no correspondence will be entered into.

  1. Amendments to T’s & C’s

The Landlord reserves the right to amend these T’s & C’s, with reasonable prior notice, if necessary.

  1. Marketing Communication

By entering, Participants consent to the Landlord storing their contact details for marketing purposes, unless they opt out by:

  • Ticking the opt-out box provided, or
  • Contacting the Landlord at 072 638 4383 or unathi@mallmarketing.co.za.

Participants who initially consent may later withdraw using the same contact details.
